1. Acceptance of Terms

By accessing or using PeakPost, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the service. PeakPost is a tool that connects to your TikTok account to provide analytics and posting recommendations.

2. Description of Service

PeakPost reads your TikTok data — including follower activity statistics and recent post performance — via TikTok's official APIs. We process this data to calculate and display recommended posting windows. The service is provided "as is" and we make no guarantees about specific outcomes (e.g., viral reach, follower growth, or engagement rates).

3. Eligibility

You must be at least 13 years old to use PeakPost. If you are under 18, you represent that you have parental or guardian consent. You must have a valid TikTok account and the legal right to grant us the permissions required by the TikTok Login Kit and Research API.

4. User Responsibilities

• You are responsible for maintaining the confidentiality of your account and session.
• You may not use PeakPost to scrape, mine, or otherwise extract data from TikTok in ways that violate TikTok's Terms of Service.
• You may not reverse engineer, decompile, or attempt to discover the source code of PeakPost.
• You may not use PeakPost for any illegal or unauthorized purpose.

5. TikTok API Access

PeakPost connects to TikTok through official APIs. By using our service, you authorize us to access the data scopes you approve during the TikTok Login Kit consent flow. You can revoke this access at any time through your TikTok account settings. We do not store your TikTok password.

6. Intellectual Property

All code, designs, logos, and content provided by PeakPost are our property or licensed to us. You may not copy, modify, distribute, or create derivative works from our service without explicit permission. Your TikTok content and data remain your property; we only use it to provide the analytics service.

7. Limitation of Liability

To the maximum extent permitted by law, PeakPost and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the service. This includes, without limitation, damages for loss of profits, goodwill, data, or other intangible losses. Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim (or $0 if you are on a free plan).

8. Termination

We reserve the right to suspend or terminate your access to PeakPost at any time, with or without cause, and with or without notice. You may stop using the service at any time. Upon termination, your right to use PeakPost ceases immediately, though cached data may remain in our systems for up to 30 days as described in our Privacy Policy.

9. Changes to These Terms

We may update these Terms of Service from time to time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of PeakPost after changes constitutes acceptance of the revised terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction where PeakPost's operating entity is registered, without regard to conflict of law principles.
